1. Introduction
This Privacy Policy describes the information processing practices of Intelius, LLC ("Intelius", “we”, “us”, "our" or similar pronouns) on the intelius.com website intelius.com website https://www.intelius.com/, its mobile application, and all subdomains and feeder sites with other domains that we operate to direct traffic to intelius.com, collectively, the "Site"). This Privacy Policy is only applicable to the Site and not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that may differ materially from this Privacy Policy. This Privacy Policy is expressly incorporated into our Terms of Use, which govern your use of our Site.

2. Personal Information Collection Practices
I. PERSONAL INFORMATION COLLECTED
We collect a number of different types of information about you when you visit the Site and use the Site (collectively, “Personal Information”):
1. User Information. User Information is the information that you provide and that we and our customer care team collect from you when you use our Site or if you communicate with us by phone, email, post messages to any of our chat groups, bulletin boards, or forums, or otherwise complete online forms, surveys, or contest entries. User Information may include: (1) Contact Data (such as your name, mailing address, and e-mail address); (2) Financial Data (such as your account or credit card number); and (3) Demographic Data (such as your zip code and age).
2. Traffic Data. Traffic Data is data we may automatically track and collect when you visit our Site, such as: (1) Event Data, which includes: (i) Internet Protocol ("IP") address, (ii) access times, (iii) browser type and language, (iv) Internet Service Provider ("ISP"), (v) the pages you visit on our Site, (vi) the Content you view on our Site, and (vi) the URL of the page that referred you to our website; (vii) any data input on the Site; (2) domain servers; and (3) types of devices you use to access the Site, including your Device ID and operating system. Traffic Data also includes data collected from Cookies, Web Beacons and other technologies, as described separately in this Privacy Policy, and may include information we receive from third parties, such as social media or analytics companies.
3. Third Party Data. Third Party Data is the information we may obtain from a third party through your use of our services, including from social media, credit reporting agencies and financial institutions, public sources, and private sources and data providers. Such data may include your credit score, financial transaction and account information, and personal identifying information.
4. Information We Infer. We may derive information or draw inferences about you based on information we collect about you. For example, based on your browsing or purchases, we may infer your interest in certain of our products or brands, or information about your purchasing activities over time.
While we also source Publicly Available Information from various publicly available databases, government entities, commercial data providers, and websites to create our reports and provide the services and materials on our Site, that information is not considered Personal Information under applicable law or this Privacy Policy. See Section 9 below for more information regarding Publicly Available Information and any options we may provide you to limit the display of that information on the Site.
II. USES OF PERSONAL INFORMATION COLLECTED
Your Personal Information may be used for a variety of activities, including to:
- Operate, maintain and improve the Site and its services;
- Enable you to access and use the Site;
- Send you notices, updates, security alerts and support and other messages;
- Provide and deliver the services and features you request, process and complete transactions, and send you related information, including purchase confirmations and invoices;

- Monitor and analyze trends, usage, and activities in connection with the Site and services it provides for marketing or advertising purposes;

- Personalize and improve the Site, and provide content, features, and/or advertisements that match your interests and preferences;

- To ensure you receive proper notifications, we collect certain information about your device such as operating system and user identification information;
- Link or combine with other information we receive from third parties to help understand your needs and provide you with better service;
- To verify your qualifications and identity for certain products or services and to bill you for products and services;
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
- For testing, research, analysis, and product development
- For legal purposes consistent with applicable laws;
- To facilitate the operation of and improve the technologies made available when you interact with us and the Site, including AI technologies; and
- For other purposes that are essential to the Site’s functionality.
In addition, we use Publicly Available Information to provide our services to you and other users, and otherwise generally to improve and operate our Site.
III. COOKIES, WEB BEACONS & LOCAL STORAGE
Cookies, pixels, and web beacons are small text or graphics files that are stored on your computer when you visit certain web pages. We collect information through cookies, pixels, web beacons, and other tracking technologies about your web browsing activities, such as the address of the page you are visiting or the referring or exiting pages you have visited, the date and time you are viewing the page, your browsing environment, your IP address, your geographic location, and your device or display settings. We may use cookies, pixels, web beacons and other local storage on our Site for the following purposes:
- Detecting security incidents and for fraud prevention;
- Understanding traffic patterns and the number of visitors to the Site and other websites that we partner with;
- Understanding how you use and interact with the Site;
- Improving our products and services;

Please note that some of these tracking technologies may be placed by us (first party) or by a third-party service provider who performs these functions for us, such as Google Analytics, Meta or others. We may also use local storage and session storage which create files on your device that we use for authentication and to store user preferences, application settings and cached data. You can delete these files by deleting your browsing data.
IV. SHARING OF PERSONAL INFORMATION
We may share your Personal Information with advertisers and other third parties as part of our service to you. We do not share your Financial Data with these third parties, though we may share Financial Data with business partners who assist us by performing core services (such as hosting, billing, fulfillment, or data storage and security) related to our operation of the Website. Those business partners agree to uphold the same standards of security and confidentiality described in this Privacy Policy, and they will only use your Financial Data to carry out their specific business obligations to us.
We also disclose your Personal Information for a business purpose to the following categories of third parties:
- Our affiliated companies, including our sibling, parent and related entities for business purposes consistent with this Privacy Policy, such as those who provide customer care and other technical support;

Lastly, if we are involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred, your Personal Information may be shared with third parties to effectuate this activity in accordance with applicable law.

We also may aggregate, de-identify, and/or anonymize any information collected through the Site or Services such that such information is no longer linked to your Personal Information. We may use and share this aggregated and anonymized information (which is no longer considered Personal Information) for any purpose, including without limitation, for research and marketing purposes, and may also share such data with our affiliates and third parties, including advertisers, promotional partners and others.
V. INTEREST-BASED ADS
We may also share your Personal Information with advertisers and other third parties who may use it for advertising purposes, including to serve targeted advertising on unaffiliated third-party sites. These companies may utilize cookies, pixels, web beacons or other technologies to collect user information (e.g., hashed, de-identified data, click stream information including pages viewed on our Site, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to this and other websites to provide advertisements about goods and services likely to be of greater interest to you. VII. CONTESTS, SWEEPSTAKES, SURVEYS AND PROMOTIONS
We may conduct or co-sponsor contests, sweepstakes, or other offerings. In such circumstances, the Personal Information we obtain from you may be shared with our co-sponsor, who will be identified at the point in which you submit your information. Our co-sponsors will have the right to use your Personal Information for their own purposes, in accordance with their own privacy policies. If you do not wish for the Personal Information we obtain from you to be shared with our co-sponsors, please do not participate in these co-branded offerings.
VIII. REFER-A-FRIEND PROMOTIONS AND SIMILAR INCENTIVE PROGRAMS
We may offer referral programs, promotions such as sweepstakes, or other incentivized information collection programs. We may offer incentives to you such as discounts or promotional items or credit in connection with these programs, wherein you provide Personal Information regarding your friends or colleagues (such as their email address) and receive rewards when they sign up to use our Site. (The referred party may also receive rewards for signing up via your referral.) Alternatively, we may ask you to provide your Personal Information in exchange for a reward or participation in a promotion. If you provide Personal Information of yourself or another for these purposes, you represent and warrant that are authorized to do so. If you do not have such authority, do not provide the Personal Information. These programs are entirely voluntary and allow us to grow our business and provide additional benefits to you. The value of your information to us depends on how you ultimately use our Site, whereas the value of the referred party’s information to us depends on whether the referred party ultimately uses our Site. Said value will be reflected in the incentive offered in connection with each program. You may withdraw from the incentives at any time by contacting us.
IX. TESTIMONIALS
We publish testimonials provided by our customers on our Site in addition to other endorsements. If you provide a testimonial, we may publish it on our Site or otherwise use it consistent with this Privacy Policy and our Terms of Use, using your first name and last initial.
X. CUSTOMER CARE INTERACTIONS
We may also share your information with our customer care team and service providers who help provide the support, tools and technology to assist you and service your account. These tools and technologies may process and record your calls and correspondence and analyze your interactions with us and the Site. Advanced technologies, such as AI, may also be used to help streamline and automate the support that we provide you. We use the information that we collect to provide you support, address complaints, improve our products, services and the technologies that we use, and for other purposes set forth in this Privacy Policy.
XI. OTHER AUTOMATED DECISION MAKING
Automated decision making refers to a decision that is taken solely on the basis of automated processing of your Personal Information. We may use automated decision-making software for security reasons, such as to detect fraudulent or illegal actions, or to protect consumer safety. When we do so, you cannot opt out of the use of the decision-making technology. We do not use automated decision-making technologies to produce an adverse legal effect on you or to profile you.
XII. DATA TRANSFERS
Our Site is not intended for visitors outside of the United States and we do not direct our activities at users outside of the United States. If you are visiting the Site from a location outside of the U.S., your connection will be through and to servers located in the U.S. We also may transfer your data to third parties as necessary for the purposes set out in this Privacy Policy, which may mean your Personal Information is processed in or transferred to the U.S. and other countries and territories, which may have different privacy laws from your country of residence. Your information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. We implement appropriate technical, contractual and organizational safeguards and measures to protect your Personal information when transferred consistent with applicable laws; however, by using the Site, you consent to the transfer to, and processing, usage, sharing and storage of your information in the United States and other countries.
XIII. RETENTION OF PERSONAL INFORMATION
We will retain your Personal Information only for as long as is necessary for the purposes set out in this Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Information to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. All information you provide to us is stored on our secure servers or those of our third-party data storage providers.
We utilize the following criteria to determine the length of time for which we retain Personal Information:
- How long we have had a relationship with you or provided our Services to you
- The business purposes for which the information is used, and the length of time for which the information is required to achieve those purposes;
- Whether we are required to retain the information, or the information is otherwise necessary, in order to: comply with legal obligations or contractual commitments: defend against potential legal claims: detect or prevent potential illegal activity or actions in violation of our policies and procedures; secure our systems and online environment; or protect health and safety;

3. Confidentiality and Security of Personal Information
I. USER ABILITY TO ACCESS, UPDATE, AND CORRECT PERSONAL INFORMATION
At any time you may update your account information, such as your credit card, name and other identifying information that you provide when creating an account, by logging into your account and accessing your Account settings. In the case that your credit card, user name, or password is lost, stolen, or used without permission, promptly contact us at [email protected] to update the Personal Information we have on file for you. We will respond to access requests within 30 days.

If you delete your account, please note that we may retain cached or archived copies of your information as required by law or for legitimate business purposes, including, for example, to comply with our legal obligations, resolve disputes, and enforce our agreements.
II. SECURITY
We use reasonable security measures to protect against the loss, misuse, and alteration of the information under our control consistent with applicable laws. However, no system is 100% secure, and to the maximum extent permitted by law, we do not accept liability for any unauthorized disclosure of your information.
4. Third-Party Sites
The Site contains links to websites not operated by us. We are not responsible for the privacy practices or the content of such websites. Please review the privacy policies of each site you visit. We may also make chat rooms, forums, message boards, features where you can comment on reports, news groups and other similar features that allow you to comment publicly, available to you. Please understand that any information that is disclosed in these areas becomes accessible to the public. 5. Updates and Changes to Privacy Policy
We may update or modify this Privacy Policy by posting such update or modification on the Site, or by other means as required under applicable law. Any such change, update, or modification will be effective immediately upon posting on the Site. If you do not agree to the new changes, please stop using the Site.
6. Children’s Information
The Site is not directed to children under 16 (or other age as required for data processing under applicable law), and we do not knowingly collect Personal Information from children. If you are a parent or guardian and believe your child has uploaded Personal Information to our site without your consent, you may contact us as described in Contact Information below. If we become aware that a child has provided us with Personal Information in violation of applicable law, we will delete any Personal Information we have collected, unless we have a legal obligation to keep it, and terminate the child’s account if applicable.

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. We use Google Analytics (GA4) for certain advertising features, including Remarketing with Google Analytics, Display Network Impression Reporting, Demographics and Interest Reporting, and Signals. Certain of these features are already privacy-compliant because they use aggregated data or otherwise do not identify an individual. ADDITIONAL DISCLOSURES AND OPT OUTS FOR iOS APP
If you are using the iOS App and request a refund directly from Apple, you agree that we may share certain of your User Data with Apple to assist in reviewing your refund request when it requests such information. Apple provides that any information shared for these purposes is only used to review your refund request and not for tracking. IV. YOUR RIGHTS AND CHOICES
Subject to applicable law, if you are a resident of California, Virginia, Connecticut, Utah, Colorado, Texas, Delaware, Montana, Oregon, Iowa, Nebraska, New Hampshire or New Jersey, you may have the following rights:
- To Know and Access: to obtain a copy of the specific pieces of Personal Information we have collected about you. (Note that this right only applies to Personal Information relating to you, and not to any other user.)
- Deletion: to request that we delete your Personal Information. This right may be limited to the extent that we are permitted or required by applicable law to retain information. (Note that if you request deletion of your Personal Information, you may no longer be able to use or access the Site. If you decide to use or access the Site again, we may consider this a new account, and may collect Personal Information associated with that account in accordance with this Privacy Policy.)
- Opt-Out of “Sale” and Certain Sharing Practices: you have the right to opt-out of certain information sharing practices with third parties who do not act as our service providers. Authorized Agent: Depending on where you live, you may have the right to use an authorized agent on your behalf to exercise a privacy right discussed above. If you are an authorized agent acting on behalf of a user to communicate with us or to exercise a privacy right discussed above, you must be able to demonstrate that you have the requisite authorization to act on behalf of the user. If you are an authorized agent trying to exercise rights on behalf of a user, then you can make a request on the user’s behalf by contacting us as set forth below in the “Contact Information” section. Such requests must include a written authorization from the consumer that includes the consumer’s full name, address, telephone number and valid email address used by the consumer to interact with the Site that is signed by the consumer and clearly bestows upon the agent the proper authority. Alternatively, an acting agent can provide a valid power of attorney (as defined by applicable law) signed by the consumer on the agent’s behalf and a valid email address used by the consumer to interact with the Site. In addition to the Personal Information collected that has been detailed above, we also collect Publicly Available Information or Public Data from various databases, government entities, commercial data providers, and websites to create our reports and provide the products and services available on our Site. Publicly Available Information includes information that is lawfully made available from federal, state, or local government records and information that we reasonably believe is made available to the general public, for example, by widely distributed media.
We acquire and aggregate this information about U.S. residents, which will include users and non-users. We do not, however, include any Personal Information, including User Data and Traffic Data, that we collect directly from users of the Site within the reports, products, and services that we provide.
We collect this Publicly Available Information and make it available to consumers because we believe that affordable and convenient access to Publicly Available Information, consistent with protections afforded by the First Amendment, serves many valuable purposes including helping to protect, inform and connect people. For example, parents may use our Site to learn whether a potential carpool driver has a DUI record to protect their children’s safety. Adopted children may use our services to locate and connect with biological family members. Consumers may use our services to inform themselves about the criminal or traffic records of a potential online date or marketplace seller.
While the specific privacy rights afforded to residents of California, Virginia, Connecticut, Utah, Colorado, Texas, Delaware, Montana, Oregon, Iowa, Nebraska, New Hampshire or New Jersey do not apply to this Publicly Available Information and Public Data, we nevertheless have voluntarily elected to provide consumers with the ability to limit the availability and display of this Publicly Available Information on our Site.
